Terms of Service

By scheduling an appointment with Cathy Orten (“Coach”) and Lily Rene LLC, dba Cathy Orten Coaching (“Company”), you (“Client”) agree that Coach will provide services to Client as outlined below. The Company, Coach, and Client (“Parties”) agree that the Agreement shall be governed by and interpreted under the laws of the state of Alaska.

1. Service Structure of the Coaching Sessions/Packages (“Program”)

• Each session scheduled will be a Private session between Coach and Client.
• Access to digital products such as the QB Weight Loss Success Course is included under the 'Product Access and Usage' detailed later in this document.

2. Payment Structure

• All Payments are non-refundable.
• Payment details for subscriptions and digital products are specified under the 'Subscription Management' and 'Refund Policy for Digital Products' sections.

3. Cancellation

• Client acknowledges that they may terminate or discontinue the coaching relationship at any time, and Client agrees that coaching fees paid by Client are nonrefundable and any remaining balance is due within 30 days of cancellation.

4. Method of Communication

• The Parties agree that coaching sessions will occur either by phone call or via online conference call, unless otherwise agreed upon by both Parties.
• For AI-integrated services like Lily Bot, refer to the 'Technology and AI Integration' section for communication protocols.

5. Limitations of Coaching

• Client understands that Coach is not a mental health, medical, or health professional. Client agrees that coaching is not to be used as a substitute for professional advice by mental health, medical, health, or other qualified professionals.

6. Spot Coaching between Sessions

• Client may text or call the Coach for support if urgent issues or questions arise between scheduled sessions, and Coach will respond in a reasonable time frame through text or a quick call.

7. Communication

• Client gives consent to using online cloud-based documents, online storage, text, emails, or any other online software to sometimes transmit possible sensitive information.

8. Process

• Client understands that the Coach will communicate with honesty and straightforwardness, including asking powerful questions, making requests, and suggesting action steps.
• Support for digital products and services, including troubleshooting, is specified under the 'Support and Maintenance' section.

9. Results and Guarantees

• Results of the Program can and do vary. The Coach makes no guarantees.

10. Missed Sessions

• Client agrees to cancel and reschedule their booked session at least 24 hours in advance if an unavoidable schedule conflict arises.

11. Confidentiality

• The Client image and specific personal information discussed or provided during sessions will be kept strictly confidential unless the Client gives explicit written approval, except as required by law.

12. Intellectual Property

• Client agrees that all tools, processes, audio or video training, and documents provided by Coach are the intellectual property of Coach.

13. Audio and Video Recording

• Under Alaska state law, parties must consent to any voice or video recording.

14. Payments, Chargebacks, or Disputes

• Client acknowledges and affirms that all payments under this Agreement must be made as scheduled by Client to remain in good standing and continue receiving Program components.

15. Legal Disclaimer

• Client understands that Coach provides a holistic approach to coaching.

16. Agreeance (in everyday language)

• All payments are non-refundable.

Support and Maintenance

• Technical support for digital products and services will be available via email at cathy@CathyOrten.com. Clients can expect a response within 48 hours on business days.

Technology and AI Integration

• Services incorporating AI technologies, including the use of our AI coach, Lily Bot, will adhere to specific communication and data handling protocols as described in this section.
